Terms of Use

These Terms are designed for EPI’s full website—not only paid rehab programs. They address public health and exercise content, the exercise library, clinic information, member accounts, digital purchases, payments, intellectual property, and appropriate use.

These Terms of Use (“Terms”) govern your access to and use of the Elite Performance Institute website, including public educational content, the exercise library, online accounts, paid digital programs, and other online services we may offer. By using the website, creating an account, or purchasing a digital product, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use member-only services or purchase digital products. Additional patient forms, financial policies, consents, or notices may apply when you receive in-person healthcare services from Elite Performance Institute.

Elite Performance Institute is a chiropractic, sports rehabilitation, movement-analysis, and performance practice in Naperville, Illinois. Our website also provides general educational information, exercise demonstrations, and may sell self-guided digital rehabilitation or performance programs.

These Terms apply to the website and online products. They do not replace or modify the clinical consent forms, financial agreements, privacy rights, professional standards, or legal duties that apply to healthcare services provided to an actual patient.

Public website content, blog posts, exercise videos, social media content, and self-guided digital programs are provided for general educational and informational purposes. They are not a diagnosis, individualized treatment plan, medical prescription, or substitute for an evaluation by an appropriately licensed healthcare professional.

Using this website or purchasing a self-guided digital program does not, by itself, establish a doctor-patient relationship with Elite Performance Institute or any clinician at the practice. A clinician-patient relationship is established only through the applicable clinical intake, evaluation, consent, and care process.

Exercise and rehabilitation are not appropriate for every person or every condition. Stop an activity and seek appropriate evaluation if you experience concerning or rapidly worsening symptoms, significant trauma, inability to bear weight or use a body part normally, marked swelling, new neurologic symptoms, chest pain, shortness of breath, fainting, or another symptom that may require medical attention. For a medical emergency, call 911 or your local emergency number.

Some digital products may require an account. You are responsible for providing accurate registration information, protecting your password, and maintaining the confidentiality of your account. You are responsible for activity that occurs through your account unless prohibited by law.

Member access is intended for the individual purchaser and may not be shared, transferred, resold, publicly posted, or distributed to others. We may suspend or terminate access for suspected fraud, account sharing, unauthorized copying, abusive conduct, or material violation of these Terms.

Prices, included content, access periods, and any subscription terms will be displayed at or before checkout. You agree to provide current and accurate billing information and authorize the applicable payment processor to charge the payment method you select.

Online payments may be processed by Stripe or another payment provider identified at checkout. We do not control the payment provider’s separate terms, security procedures, or privacy practices.

If a product is sold as a recurring subscription, the subscription will renew according to the interval shown at checkout until canceled. You are responsible for canceling before the next renewal date if you do not want another charge. Any applicable cancellation instructions will be available in your account or through EPI customer support.

When you purchase a digital rehabilitation, exercise, or educational program, you receive a limited, personal, non-exclusive, non-transferable, revocable license to access and use the purchased content for your own personal use, subject to the access period and purchase terms shown at checkout.

You may not reproduce, republish, distribute, sell, sublicense, share login credentials, create derivative commercial products from, scrape, systematically download, screen-record for redistribution, or otherwise exploit paid content without prior written permission from Elite Performance Institute.

Physical activity carries inherent risks, including soreness, aggravation of symptoms, falls, strains, and other injuries. By choosing to perform an exercise or self-guided program, you are responsible for selecting an appropriate environment, equipment, resistance, range of motion, and level of effort for your abilities and condition.

No online program can account for every diagnosis, medical history, medication, surgery, pregnancy, cardiovascular condition, neurologic condition, or other factor that may affect exercise safety. If you are uncertain whether a program is appropriate for you, obtain individualized guidance before beginning or progressing it.

Purchases of self-guided digital rehabilitation, exercise, and educational programs are final and non-refundable once access is provided, except where a refund, cancellation, withdrawal, or other consumer right is required by applicable law. Our Refund Policy is incorporated into these Terms.

Where permitted by law for immediately supplied digital content, we may require you at checkout to expressly request immediate access and acknowledge that beginning delivery of the digital content may cause you to lose a statutory withdrawal or cooling-off right.

Subscriptions, promotions, events, or other products may have additional terms disclosed at checkout. Nothing in these Terms limits non-waivable consumer rights that apply under the law of your jurisdiction.

Unless otherwise stated, the website and its original content—including text, graphics, page designs, exercise descriptions, videos, photographs, logos, downloadable materials, program structure, and other materials—are owned by or licensed to Elite Performance Institute and are protected by applicable intellectual-property laws.

You may view and use public content for ordinary personal, noncommercial purposes. No ownership rights are transferred to you by viewing the website, purchasing a program, or receiving account access.

You agree not to misuse the website; attempt to bypass security or access controls; interfere with website operation; introduce malware or harmful code; scrape or harvest content or personal information; impersonate another person; use another person’s account without permission; infringe intellectual-property or privacy rights; or use the website for unlawful, fraudulent, abusive, or deceptive purposes.

The website may link to or incorporate services operated by third parties, including Stripe, YouTube, Google, social media services, mapping services, review sites, and other platforms. Third-party services are governed by their own terms and privacy policies. A link or integration does not mean we control or guarantee the third party’s service.

Testimonials, reviews, case examples, and descriptions of outcomes reflect individual experiences and do not guarantee that you will achieve the same result. Rehabilitation and performance outcomes vary based on diagnosis, duration of symptoms, adherence, training load, health status, and many other individual factors.

We aim to keep website information accurate and current, but health and exercise information evolves and website content may become outdated. We may update, remove, or change content, program features, prices, or availability without guaranteeing that every page will always be error-free or continuously available.

To the fullest extent permitted by applicable law, the website and online content are provided on an “as is” and “as available” basis without warranties that the website will be uninterrupted, error-free, or suitable for every individual purpose.

To the fullest extent permitted by law, Elite Performance Institute will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of the public website or digital content. This limitation does not apply where liability cannot legally be limited or excluded.

These online Terms do not waive, limit, or alter any rights or duties that cannot lawfully be waived in connection with professional healthcare services, clinical negligence, patient privacy, or other obligations imposed by applicable healthcare law.

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except to the extent the law of another jurisdiction provides a non-waivable consumer right that applies to you.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

We may update these Terms periodically. The “Last Updated” date identifies the most recent revision. Continued use of the website after revised Terms become effective constitutes acceptance to the extent permitted by law. For material changes affecting an active paid account or subscription, we may provide additional notice where appropriate.
